How it works

How maternity benefit is calculated

The Maternity Benefit Act, 1961, as amended in 2017, entitles a woman to paid leave around childbirth, funded either by her employer or, if she is insured, by ESIC. For the first two children she gets 26 weeks of paid leave; from the third child onward, and for a mother who adopts a child below three months or is a commissioning mother in surrogacy, the entitlement is 12 weeks. The benefit paid is her average daily wage for every day of that leave. The average daily wage is worked out from her earnings, and this tool computes it as the monthly gross wage multiplied by twelve and divided by 365, then multiplies it by the number of days in the entitled leave (weeks × 7). To be eligible she must have worked at least 80 days in the twelve months preceding the expected date of delivery. Where the employee is covered by the ESI scheme — because her gross wage is within the ESI ceiling of ₹21,000 — the benefit is paid by ESIC rather than the employer, though the amount is calculated the same way.
