Confirmation Letter Format
A confirmation letter is issued by an employer to formally confirm an employee's status as a permanent employee after successful completion of their probation period. It marks the transition from probationary to confirmed employment and often triggers full eligibility for benefits.
In India, HR issues this letter once the reporting manager has reviewed the employee's performance during probation and recommended confirmation, typically at or shortly after the end of the probation period specified in the appointment letter.

- § There is no central statute mandating a maximum probation period across India; probation duration and confirmation process are governed by the employment contract and, where applicable, certified Standing Orders under the Industrial Employment (Standing Orders) Act, 1946 for larger establishments.
- § If an employer allows an employee to continue working significantly beyond the stated probation period without formal confirmation or extension, some courts have inferred implied confirmation, so timely issuance of this letter (or a probation extension letter) is important to avoid ambiguity.
- § Benefits that are tenure-linked (e.g. gratuity eligibility under the Payment of Gratuity Act, 1972, which requires 5 years of continuous service) are typically calculated from the original date of joining, not the confirmation date, unless the contract states otherwise.
